Must a CC register for Corporate Income Tax

The Government Gazette 36603 vol 576 released on 28 June 2013 is explicit that every company, trust or other juristic persons, which is a resident, must furnish an income tax return.

Corporate Income Tax IT is applicable (but not limited) to the following businesses which are liable under the Income Tax Act, 1962 for the payment of tax on all income received by or accrued to them within a financial year. A company refers to the following:

• Listed public companies
• Unlisted public companies
• Private Companies
• Close Corporations
• Co-operatives
• Collective Investment Schemes
• Small Business Corporation (s12E)
• Body Corporates
• Share Block Companies
• Dormant Companies
• Public Benefit Companies

Therefore, it is explicit that a CC (Company) has to register for corporate income tax and any suggestion to the contrary is mischievous.
